Q: Can I file a trade mark by myself?

A: Yes, when you like to come for a visit to Monaco, you can file your trade mark at the Monaco Patent and Trademark Office (Service de la propriété intellectuelle) yourself. Formal requirements for filing a trademark in Monaco see here. Everyone who does not intend to come in person needs a local representative.

 

 

Q: What are trademark classes?

A:  When registering a trademark, you are required to specify what types of products or services you are using the trademark for. There are 45 different classes for different types of products or services. The first 34 classes embrace different types of goods, such as pharmaceuticals and veterinary preparations (class 5), machines and machine tools (class 7), vehicles (class 12), precious metals, jewelry and horological and chronometric instruments (class 14). 11 classes are used to categorize different services such as business/advertising services (class 35), insurances and financial affaires (class 36), telecommunication services (class 38) and building construction (class 37), to name a few. For each class you have to pay a seperate fee. In Monaco you will get the first three classes for the price of one.

The original function of the trademark classes was to reduce the work to perform a search for an older trademark. Even if a trademark of one trademark owner and the same or similar trademark of another trademark owner are filed in different classes they might considered to confuse the public. The owner of the earlier filed trademark in this case has the right to ask for deletion of the later filed trade mark.
