Recording Changes of IP Holders

 

What is the urgency?

In order to be able to react quickly to counterfeiters and infringers, the records at the Monaco Patent and Trademark should be up-to-date. Therefore any change of the legal situation of the owner of a patent, a trademark or an industrial design, such as change of name, change of address, change of ownership, or change of legal form should be registered in the special register of the Monaco Patent and Trademark Office promptly.

What is required?

a) Change of ownership 

To record a change of ownership of any IP titles, we must receive a copy of the contract of the change of ownership and a certified translation into French. We must first register the contract at the Monaco Tax Office and then at the Monaco Patent and Trademark Office. The stamp duty is 10 Euros per document plus 1 Euro for each page. It takes normally one to two weeks to have a contract registered at the Monaco Tax Office and the MCPTO.

b) Change of address, name or legal form

Changes of address, name or legal form do not need to be registered at the Monaco Tax Office. We can record the changes directly at the Monaco Patent and Trademark Office. However, we do require copies of the documents that prove these changes, such as a copy of the extract of the register of companies accompanied by certified translation into French.

You must send us also a power of attorney in the name of the new owner, or with the new address as the case may be.
